Irene owns and runs a store in South Surrey. Last week, she received a shipment of switchblade knives.She placed one of the knives in the store window, alongside a large sign that said, "Switchblade Knives- $45 Each"

One Tuesday afternoon, a customer came into the store after seeing the knife display in the store window, picked up one of the switchblade knives and said to Irene, "I accept your offer, I'll take one of these knives for $45".

Just at that moment, the local police burst into the store and arrested Irene. Irene was arrested and charged with a crime under section 7 of theProhibited Weapons Act, which says it is illegal to "make an agreement to sell oroffer to sellany switchblade knife".Punishment under theProhibited Weapons Actis as follows:

for offering to sell a switchblade knife, a $10,000 fine.

For agreeing to sell a switchblade knife to someone, a $50,000 fine and six months in prison.

The police told Irene she is being charged with both offering the blades for sale and agreeing to sell the switchblade knife based on the customer who agreed to buy the switchblade that Tuesday afternoon.

If principles of contract law are applied to this situation, will the Crown succeed in prosecuting Irene for either offering or agreeing to sell the switchblade knife?
