It is a known fact that Ellen's catering business is in financial trouble. In response to the concern that the business will go bankrupt and all of the employees will lose their jobs, a group of older employees approach Ellen and tell her if she offers them early retirement incentives, they might consider retiring, which would significantly reduce the company's payroll costs. Ellen explains this is not an option, because any consideration of age with respect to employment matters will subject her to liability under the ADEA for age discrimination, which would only add to her dire financial situation.
