Monica is rushing through Union Station to catch a train to go visit her parents. Rachel is walking slowly through the station. Rachel is carrying a lot of shopping bags, and Monica cannot get around her. Finally, a very frustrated Monica just pushes Rachel out of the way. Rachel is startled and grabs Monica's arm, bruising her. Has a tort been committed? No. This is just a commonplace exchange in a crowded and busy location. Monica did not commit a tort because Rachel was infringing on her right of freedom of movement. Rachel did commit the tort of assault by imposing physical contact without Monica's consent, causing damage. Yes. Monica pushing Rachel out of the way was assault.
