It was 6 PM and Mr. Williams asked Jody, a CNA, to let him go outside in the enclosed courtyard to look at the flowers. Jody said fine but she would have to accompany him. Mr. Williams has Parkinson's Disease and was at risk for falls due to his condition. Jody and Mr. Williams walked by the front lobby and went to the door leading to the courtyard. The said hello to Andy who was at the front desk covering for the receptionist who was on break. There were also a few residents and family members looking out to the courtyard through a bay window. Mr. Williams recognized one the family members who was visiting another resident, said hello, and went outside with Jody.

Jody was seen saying something to Mr. Williams and left the courtyard. Mr. Williams was left alone sitting in a patio chair. After ten minutes Mr. Williams decided he wanted to walk around the courtyard and got up. He took three steps and fell, hitting his head on the sidewalk. Family members visiting other residents witnessed this and went to the front desk to tell Andy that Mr. Williams had fallen. Andy said, "Oh, Mr. Williams has Parkinson's Disease and falls all the time. I'll call the unit to get someone to pick him up." One of the visitors said, "You should check on him; I think he hit his head." Andy, in no particular hurry, went out to see Mr. Williams, who by this time was back sitting in the patio chair, having gotten himself up. Jody came running to see what had happened. Mr. Williams had a good sized gash on his forehead and was bleeding.
