It was August 29, and Lester, a high school senior, was again late for football practice. The head coach, being very agitated by Lester's repeated tardiness, put Lester and a couple of other players who had broken some rules in a school van at the end of practice and takes them 5 miles down an oil road and told them to run back to school in time to catch the bus home.He drove along behind them as they ran.Lester was in a hurry to get back to school because he had no other way home except to ride the bus, and he was afraid it would leave without him. Therefore, he decided to cut across a field to get back to school. On the way, he attempted to jump over a creek, but fell and broke his leg.The coach had seen Lester cut across, but didn't see him fall, and was not aware that Lester did not make it back until Lester's mother called him that evening.A search was made and Lester was found, in great pain.He will recover, but since he tried to run on the leg before the doctor told him he should, he reinjured it.The injury to his leg will keep him from playing football again. He was a pre-season all-state selection, and had already been talking to Texas A&M about playing for them under full scholarship next year. Now he will not be able to attend college without the scholarship, and his hopes for a professional football career are gone.Lester blames the coach and the school for his plight, and wants to sue.EXPLAIN what Lester's chances for winning a lawsuit would be, what things (that's plural) the school would plead as defenses to Lester's actions. If he could win the suit, what damages might he be expected to recover?
