Think about al the torts and cases we discussed in class, and remember that someone does not have to be right to claim you did something wrong. Also, discuss what the business could (or should) do to reduce the risk of these torts from occurring. 1. In addition to the duty of reasonable care, what other duties (if any), does your business/company owe and to whom are these duties owed? Think about possible heightened or extra duties owned on the entity you have selected, the type of business you operate, and whether you have a physical location. m. Described to circumstances under which someone could assert negligence claims against your company/business. Make sure your scenarios include sufficient facts to address the elements of negligence, i.e., Duty, Breach, Causation, and Damages. Also, discuss what the business could (or should) do to reduce the risk of these torts from occurring V. Product liability & Warranties n. Described breach of warranty claims, if any, your company could face. If your company would not be exposed to such claims, explain why not. o. Similarly, explain any product liability claims your company might face or explain why it would not be exposed to any such claims. VI. Agency p. Discuss who has authority to act on behalf of your company and in what ways. Think about someone who can be deemed to have agency authority at any level. VIII. Intellectual Property s. Described some of the specific forms of intellectual property your company will have or produce. Your company may not have intellectual property in all four types discussed in class, but most likely will have at least one or two. 1. What will your company do to protect its intellectual property? Each type has its own methods of protection or preservation of rights. so be sure to address how you would protect each type you have. IX. Ethics u. Outline a Code of Ethics for your company (reference, but Do NOT copy, the Costco Code of Ethics in the Text in order to formulate your own areas of ethical concern). Be sure to consider each of the legal topics discussed throughout the semester in identifying the areas of ethical concern and any conduct you will encourage/prohibit in order to ensure ethical decision making within your company
