Jack and Jill, UTSA college sweethearts and recent graduates are shopping to buy a house together having just started new jobs they are looking for a cheap real fixer upper. They find this one house that has been abandoned for some time and for whatever reason upon closer inspection you can tell that under the dust and wear and tear it was a mighty beautiful house in its day. Jack and Jill ask the real estate agent "why has no one picked up this house over the years?" The sale price is great, but some work would have to be put into it. The agent said that people don't want to buy a "money trap." In truth, there was a murder in the house five years ago and everyone in the neighborhood thinks the victim still lives in house and roams at night through the rooms and halls. No one has been able to stay for one night even as a rental, they get so scared. Unkown to Jack and Jill and thinking it was a great deal, Jack and Jill sign the contract and buy the house. They move into the house and sure enough, Jill is awaken to suspicious sounds through the house at all hours of the night. Doors open, and close and water faucets unexplainably turn on and off. Spooked having never lived in an old home and accustom to living in an apartment she wants Jack to have the owners take back the house and get their money back.
Can Jack and Jill prevail why or why not? Provide case law to support your positon advising Jack and Jill of their rights of any.
