Jack promise to take his son, Alan to genting highlands for his birthday. Due to landslip, the trip is cancelled. Alan cannot sue Jack for breaking his promise because:

1) there is no consideration given by Alan

2) the parties have no intetion to creat legal relations

I do see answers stating answer 2, but why can't it be answer 1?
