Jacob Moore and Melanie Jane have been friends for approximately 2 years. Last year, they started dating and they became engaged to be married. Jacob is 23 years old and Melanie is 21 years old. Melanie lives at home in Scarborough Ontario with her mother and her little sister Kelly who is 8 years old. Jacob sometimes visits Melanie at her home. Jacob has met Melanie's mother twice and her sister on one occasion. Jacob has a criminal record. He has gotten into trouble with the law for minor offences such as breaking a school window when he was 18 years old and stealing a car when he was 19 years old. Once in a while, Jacob hangs out with friends who sometimes get into trouble and whom have been arrested for minor criminal offences. One day, Jacob and his friends were tossing around a baseball when they accidentally broke a window at a house. That house was approximately one block away from Melanie's house. In the moment that they broke the window, the police just happened to be driving by and attempted to detain Jacob and his friends. Jacob ran from the scene and was chased by a police officer. Jacob ran straight to Melanie's house and rapidly knocked on the door. Melanie's 8-year-old sister, Kelly, answered the door. As she began to open the door, Jacob said hi to Kelly and ran into the residence. After he entered the house, he saw Melanie's mother and told her that the police were chasing him. She asked him why they were chasing him when he told her that he was with his friends and that they accidentally broke a window at a house a block away. The police then knocked on the door. When Melanie's mother answered the door, the police officer instantly charged into the house. When the police saw Jacob, without hesitation, they instantly handcuffed and arrested him and charged him with Forcible Entry as per section 72 of the Criminal Code.
