Jamani is a self-employed fashion designer. Her old computer broke down just as she was completing a design sketch to send to a client. She rushed to Computers R Us to buy a new computer to use in her business. She looked at several computers and decided to buy a new desk top Lennox computer for $3000. She asked Kerry, the sales assistant, if it was a good computer and whether it would run Fashion Editor GT (a specialized software used by fashion designers). Kerry told her that all of the computers were thoroughly tested before being put out for sale and that the computer would definitely be able to run Fashion Editor GT. He also told her that the computer was of the best quality and would outlast her grandchildren.

Jamani bought the computer and rushed home with it to complete her work. When she arrived home, she turned on the computer and tried to install the Fashion Editor GT software. She discovered however that the computer's operating system was incompatible with Fashion Editor and that as a result, she would not be able to install it. Furthermore, the computer overheated and stopped working about two hours after she set it up.
