James is married to Ayla. By a former marriage James has a daughter, called Beatrice, who is aged 16 years of age. Beatrice lives on a day-to-day basis with her mother, Caroline. Beatrice occasionally stays with James and Ayla at weekends and during the school holidays. James has an Uncle Clarence who lives with James and Ayla.
Beatrice is in a relationship with a 16-year-old boy, called David. She has discovered she is pregnant. Beatrice would like to have an abortion as she does not feel mature enough to be a mother and financially cannot support a child through her school studies. James is opposed to this on religious grounds. Caroline agrees with her daughter that there should be an abortion. David would like to be a father and therefore opposes the abortion.
James and Ayla have just had a son, called Callum. Following the difficult birth of the child, Callum was placed on a ventilator in the neonatal intensive care unit. Doctors concluded that the child was clinically dead, but the child remained connected to the NICU ventilator, his heart continued to beat, and he was fed. James and Ayla do not accept that Callum is dead. The Hospital wishes to seek permission from the court to turn the ventilator off and disconnect it. The issue for the court was whether Callum is dead and whether it is in the best interests of Callum to remove the ventilator. The Hospital argues that the best interest's analysis clearly means that the ventilator should be turned off. James and Ayla would like to take Callum to a clinic abroad, as they have been told of research into a miracle cure.
Uncle Clarence has been ill for some time and experiences a great deal of pain. There is no cure for his illness, and he faces some two or three years of pain before he will die. He would like to ask his doctor to give him an overdose injection of pain killer so that he can die quickly.
- Advise whether Beatrice can be stopped by James and David from having an abortion.
- Advise James and Ayla whether the court will order Callum to be removed from the ventilator and stop any other treatment.
- Advise Uncle Clarence's doctor whether he can give Uncle Clarence a very large dose of pain killer that will cause him to die.
