At the time of his death, James had a sailing boat, which he had said at a dinner party it should be given to his friend Shefali, English Thread Stainless Steel 44 - Piece Canteen set, 500,000 in cash and the family home which was registered in his name worth 450,000.Prior to his death James had indicated to Josephine that he wished to donate some of the money to Wisbech Wildlife Society a registered charity.

Josephine suffers from severe anxiety and depression and as a result is not able to work, she relied on James' income to support her. James paid for the mortgage and all the day to day activities. Josephine has no savings and cannot afford to rent somewhere else.

Please advise:

(a) Who will be responsible for administering James' estate? Discuss the duties of the Personal Representatives? 10%

(b) How will James' estate be distributed? Discuss whether Shefali and Wisbech Wildlife Society will be able to receive anything from the estate and any other issues that arise as a result of the distributions. 15%

(c) What claims (if any) will Josephina have against the estate and the likelihood of success? 25%
