Jan was walking her dog one Saturday morning when she passed a house having a 'yard sale' where the owner Frank was selling various personal items out in the front yard. Jan did not really need anything, but looking through the various items for sale she saw a cute bowl that was selling at a very low price. She had enough change in her pocket to buy the bowl and took it home with her. Two weeks later Jan had a professor who teaches a course on rare and antique artifacts at the University over for dinner. The professor saw the bowl Jan recently purchased on a shelf in the living room and immediately took an interest in the bowl. After reviewing the bowl the professor recommended Jan have it appraised, that it could be very valuable. Jan laughed at the suggestion, but after significant persuasion decided to follow the advice. To her absolute astonishment, the bowl turned out to be a rare Ding bowl from the Northern Song Dynasty and worth a fortune. She listed the bowl with the infamous Sotheby's auction house where pre-sale estimates were $200,000 - 300,000USD. The bowl actually sold for $2.2 million USD and when the seller Frank found out, he sued Jan claiming the contract was void due to a mistake and he should be entitled to the bowl. Apply what you have learned regarding the mistake and determine if 1) Frank would have a valid claim, 2) what type of mistake could he argue, 3) what elements would Frank have to prove to succeed, and do the facts listed support such a claim? In other words, could Frank prevail? (FYI, in case you are curious, the facts above are mostly true, but the seller did not, to the best of my knowledge, make any claim to obtain the bowl back.) https://www.forbes.com/sites/lynndouglass/2013/03/20/rare-chinese-bowl-bought-for- 3-sells-for-over-2-million-at-auction/#203f000854e6 Question 2: In Port Vila, Hebala owns a restaurant called "Wan Smol Kanu". Hebala had just replaced the oven in the kitchen, so he advertised the old oven for sale. Floyd had just arrived in Port Vila and wanted to set up a restaurant. Floyd met Hebala at a bar situated about half a kilometer from "Wan Smol Kanu". Floyd offered to pay 300,000 vatu for the oven and Hebala accepted Floyd's offer. At the time that Floyd and Hebala made their agreement, there was, unknown to either of them, a fire at "Wan Smol Kanu" in which the oven was destroyed. When Hebala told Floyd that the oven had been destroyed, Floyd said to Hebala "You still need to get me an oven for 300,000 vatu".
