Jayant was serving in Merchant Navy. For the purpose of his official duty, he was

required to be away from family for nearly 10 months in an year. During this period, he

had been sending Rs. 10,000 per month to his brother Vasant to pay for his technical

education.

Jayant came home for a month by availing his annual leave, during this period he

observed that Vasant was not taking his education seriously and when he pointed out

the lapse, Vasant argued with him bitterly and asked him not to interfere in his life.

Jayant felt very disappointed and thereafter stopped sending Vasant the monthly

amount. Vasant tried to talk to him but Jayant never responded. Consequently, Vasant

filed a legal suit against Jayant seeking recovery of the monthly amount.

As per the provisions of Contract Act, 1872, is Jayant liable to pay the monthly amount to

his brother. Give valid reasons for your answer.
