Jeesha has been running a restaurant through a corporation called Jeesha's Bar and Grill Ltd. Jeesha is the only shareholder, director and decision-maker of the business. Jeesha also works as the manager of the corporation's restaurant.Jeesha has employee accident insurance from ABC Insurance taken out in her name- which pays her benefits including lost salary in case of injury or being unable to work.

One day, Jeesha was mopping the floor in the restaurant after the restaurant closed, and she slipped and fell, and broke her hip.She would not be able to work for several months. Jeesha therefore filled in the paperwork with ABC insurance so she could apply for benefits- including salary payment from ABC insurance while she is not working.

ABC insurance refused to pay out any money."This is your own business; you're not an employee" the representative from ABC Insurance told Jeesha over the phone.Jeesha is very angry and considers taking ABC Insurance to court to get her insurance money.

As a result of Jeesha being unable to work, Jeesha's Bar and Grill Ltd.'s business suffers a lot, and eventually goes into bankruptcy. One of the creditors of the business in the bankruptcy process is the federal government, because Jeesha's Bar and Grill Ltd. has not paid any income tax for several years. When the government contacts Jeesha about this, Jeesha says "it's not me that owes the tax money, it's Jeesha's Bar and Grill Ltd., so I don't owe you anything".Since Jeesha's Bar and Grill Ltd. has no money, the federal government considers taking Jeesha to court over the unpaid income tax from the business.

Will Jeesha be able to successfully sue and get insurance money from ABC insurance?
