Jeffrey Epcrook was employed as a sales representative for the Bernie Madoff Prius car dealership. Jane Doe, age eighteen, met with Epcrook to test drive a new Prius. During the test drive, Epcrook assaulted Jane Doe by touching and grabbing her about her arms, hands, groin area, and breasts. He also . . . exposed his genitals and placed her hand on his private parts. When they returned from the test drive, Epcrook took her to the Prius service department and again exposed himself and tried to force her to touch him. Jane Doe was able to free herself and left the dealership.

Epcrook was later convicted on criminal charges arising out of the incident. Jane Doe later sued both Epcrook and the car dealership in civil court, claiming that she had suffered severe emotional distress as a result of the assault.
