Jennifer Coy, Ms. TSU for the 2010-2011 academic year and Russell Morgan, Mr. TSU for the 2008-2009 academic year were happily married in 2013. They were such a beautiful couple and they were smart and had a lot of ambition. Mr. Morgan drove for Uber and Lyft and helped his brother with his food truck for big party events. Ms. Coy did some DJ work on the weekends and she charged fees to do make-up and wig styling videos for social groups. Mr. Morgan was a business major and had held various jobs while trying to get an MBA. He borrowed money to go to undergraduate school. He was an out-of-state student from Chicago. He went to Roosevelt University to get his MBA, but he borrowed money to cover his living expenses. Ms. Coy majored in fashion merchandising in undergraduate school. She was a resident of Georgia. They moved to Cincinnati after they got married. The couple had twin sons in 2015. Due to significant health complications in delivering the twins, Jennifer was not able to return to her job at Nostrums. One of the twins was born very small and had a breathing problem. He had to remain in the hospital for two months after his birth. Mr. Morgan was working at Wells Fargo and his entire division was fired due to credit card fraud allegations that are presently in litigation. In 2018 , he had not paid any amount on his student loans. He had used a deferment_plan and had arranged for reduced payments, but never made a payment. Therefore, he could not apply for that option again. The couple's total loan debt was about $150,000. Morgan and Coy saw no hope in trying to budget a $1,250.00 per month student loan note into their finances. Coy would need to stay home with the twins for at least three years. Morgan was having a hard time finding a job in the banking and financial sector and was waiting for the courts to clear the credit card fraud allegations. They did not know what their chances might be for relief, but the couple decided to file to bankruptcy on their students loans. The hospital bills for the delivery and care of the twins was $75,000.00 after their insurance covered eighty percent (80%) of the medical cost. Will the bankruptcy court discharge Coy and Morgan's student loans ? What test or factors will the Bankruptcy Court consider in making their decision whether or not to discharge their students loans ? Write a discussion of how the court will apply these factors to Coy and Morgan. If the court discharges some of their debt and Mr. Morgan gets a job next year, what effect might this have on the discharge granted today
