Jeremy experiences a pain in his chest, so he consults with his doctor, Dr Pilken. Dr Pilken tells Jeremy not to worry and decides not to send Jeremy for further tests. Shortly thereafter, Jeremy suffers a cardiac arrest and as a result is brain damaged. Jeremy now intends to claim damages for breach of duty of care, arguing that Dr Pilken should have taken a possible cardiac problem into account when the chest pain was detected and arranged tests and referral to a cardiologist.
