Jim has a bad driving record. He gets a job with a Plumbing Company. They typically get new employees driving records but they failed to get Jim's record. The plumbing company outfits Jim's personal truck with a rack that can carry pipes. During the hours of his job, Jim typically drives to two or three job sites each day. At 5 oclock, when Jim is no longer being paid or "on the clock" he leaves a job site andis headed home. On the way home he reaches for a cigarette lighter, his truck swerves into the oncoming lane, and he strikes a car being driven by Maeve whose 4 year old daughter is a passenger but not in any car seat. Maeve and her daughter sue Jim and they sue Jim's employer the plumbing company. The plumbing company wants the judge to dismiss it from the lawsuit. What will Maeve argue. What will Jim argue. Note, they make their arguments in the analysis section of the IRAC approach
