Jimmy, who lives in Miami, is a student studying for his Bachelor of Business Administration degree at San Ignacio University. As a result of all Fall 2020 courses being delivered totally online due to the ongoing COVID-19 pandemic, Jimmy realized that he needed to buy a new laptop computer in order to take his classes online. Jimmy was watching television at home one evening when a commercial came on that advertised new laptop computers being sold at discount prices by a manufacturer called Acme Electronics, Inc. The next day Jimmy went to Acme's warehouse in Doral to purchase a brand new laptop, which he got just in time to start the semester. He was keen to read the instruction manual carefully and used his computer just as instructed. Acme was aware that its laptops were sold at a discount because the company used defective parts that Acme knew carried the risk of overheating and causing the computers to melt. Acme had been in the laptop selling business for just two years and was eager to boost its sales by selling cheap and defective computers. One night when Jimmy was busy studying for his Midterm Exam in Finance, he decided to take a break and get a slice of pizza down the street from his apartment. Upon returning, he entered his apartment which was filled with smoke. As it happened, the computer had caught fire due to the defective parts that overheated. Jimmy's apartment suffered a great deal of damage and he lost a lot of his belongings which got burned in the fire.
Issue: Jimmy later decided to sue Acme Company as a result of the laptop that he bought from the company overheating and catching fire. Will Jimmy prevail in bringing a lawsuit against Acme Company? If so, on what legal basis. Explain below using the IRAC analytical framework.
