Job Kazi is a neighbor to Bila Hakiri. They have been neighbours for over twenty years. They live in the outskirts of Nairobi in a fast growing neighborhood. Job Kazi is polygamous while Bila Hakiri has one wife. In 2020, Job Kazi lost his job as a result of the covid 19 pandemic. He decided to sell his land. As he was really short of cash, he was selling the land at a price that was way below the market price. He decided to give his neighbor priority. When Bila Hakiri heard of the offer, he could not believe it! Land whose market price was Kshs. 5,000,000/- for an eighth of an acre was being sold for only Kshs. 1,000,000/-. Bila Hakiri had recently supplied the government with face masks and other covid paraphernalia and was therefore flush with cash. He immediately paid the entire amount to Job Kazi in cash and agreed that the transfer would be done the next day. As fate would have it, thieves broke into Job Kazi's house the same night and stole a sum of Kshs. 900.000/. Job Kazi had spent Kshs. 100,000/- on drinks at the local. Early the next morning, he went to Bila Hakiri's homestead and informed him of what had transpired overnight. He then went to the police station to report. At the police station, Job Kazi recorded a statement wherein he indicated that the money that was stolen had been his savings over the years which he had been keeping under his mattress. Bila Hakiri learned of this from his sources at the police station and became alarmed. He approached Job Kazi to seek clarification and to his surprise, Job Kazi denied ever having agreed to sell his parcel of land to him or having received any money from him as payment for the land. Annoyed at the turn of events, Bila Hakiri calls you from the police station and asks for your advice. You ask him to send you an email to your official email detailing his problem to your official law firm email. He does so. You ask him to come to the office but he says he cannot due to the huge demand for masks which he is supplying. He requests that you have a virtual meeting. (a) Conduct the meeting, advice Bila Hakiri and if necessary draft the demand letter. (b) Job Kazi receives a demand letter from a consortium of lawyers representing Bila Hakiri. He gets really worried having never received a demand letter before. He recalls that you were his classmate in high school. He still has your number though he hasn't spoken to you in five years. You have closed your office due to the covid 19 pandemic and are operating from home. You ask him to avail himself for a virtual meeting at 5:00 pm.
