John considered himself a very good driver. One day he picks up his friend Fred and they leave for the country. On the way john approaches a "No Overtaking" sign, and proceed to overtake a truck around a blind corner, and collides with Sam's car, which was coming in the opposite direction. Sam's car, as a result, runs off the road over the embankment into bushes. John and Fred go down to the bushes and see Sam in the car. Sam was not moving so they believed that he was dead. Instead of taking him to the hospital or calling the police, they wrap him up and take him further in the bushes and throw the body over a cliff. The body hits Simeon, a farmer, and he falls unconscious. When he awakens, he has a broken wrist. It is discovered that Sam suffocated from being wrapped up.

Using Jamaican legislation and cases, advise whether anyone bears any criminal liability in both the above scenario and the picture below.
