On Monday, at 9 a.m., Ben sees the car but he is late for work and telephones John from work and offers $140,000.00 and John says he will consider it. Charles goes to John's house on Monday at 11 a.m. but Sharon, John's daughter, is the only one at home. Charles leaves a note saying: "Monday. 11:05 am, plz keep car for me. Cheque of $150,000.00 left." Sharon leaves the note on her father's desk. Monday evening, John decides to accept Ben's offer and posts a letter at 2:30 p.m. to Ben's business place saying: "I agree to sell on your terms. Since it's the lower price, can you pay cash?" At 4:30 pm, Monday, John reads Charles acceptance and immediately telephones Ben's business address and leaves a recorded message: "Ignore the letter you will receive. Deal off." John. Ben is away on business and only listens to the tape on Wednesday morning. The letter arrived on Wednesday morning as well. At 2:15 pm on Monday, Dawn sees the notice and hurriedly posts a letter of acceptance and cheque for $150,000.00 in time for the 3 pm end of the day postal rounds. But in the haste, Dawn puts the wrong address and it arrives on Friday.
