John is an employee for 'Computers'r'us', a electronics store in Brisbane City. Late last month John was working the late shift and was responsible for locking-up the store, mistakenly John left the back door unlocked-but still left all the usual alarms on. Late in the night, an organised crime gang 'the gangritos' snuck in through the back and somehow hacked the alarm system, and raided the store-stealing over $10,000 in laptops and accessories. John's boss (Steve) thinks it is a inside job and suspects John of being an accomplice. Steve calls John into his office the next day and gives John an ultimatum-sign a letter of resignation Steve had prepared for him or Steve would 'give him in' to police. Naturally John doesn't want any trouble so he signs the resignation letter and leaves. In the end, the police investigation actually found John innocent-he now wants to know if he can succeed in a claim of wrongful dismissal?

Can John succeed in an action of wrongful dismissal?
