Deluxe Decor is open 7 days a week from 6am to 6pm and sells and restores furniture within the Brisbane area. Every Monday, John employs someone to help manage the store so that he can have a day off and run errands. That position is usually given to a university student seeking work experience, who is interested in learning more about furniture restoration.

One Monday morning, Sally phones Deluxe Dcor enquiring about furniture for her restaurant. Billy (an 18-year-old University student, recently employed by John) answers the phone. During the conversation Sally asks Billy, Are your tables made from genuine oak wood? Ill be ordering a large quantity from you and would need them to match the quality and appearance of the chairs and furniture at my restaurant. Billy replies, Yeah, Id have to check with John, but I am pretty sure they are. In the short time Ive been here, Ive heard him talk a lot about oak furniture. Sally replies, Alright, thats good news. Ill stop by your store soon.

Nine months later, Sally drives to Deluxe Dcor. She says to John, I phoned you a while ago to ask about replacing the old furniture at my restaurant. Appearance is so important to my clientele and the tables I own are starting to look a little dull and have lost their glossy finish. I will be keeping the chairs I currently own as I paid a lot of money for them many years ago, they are super comfortable and they havent lost their glossy, modern look. The tables need to match them as close as possible. After negotiations, John agrees to deliver Sally 25 tables within 14 business days in exchange for a $1,500 deposit to be paid upfront and $8,500 to be paid within two days of delivery.

Twenty-eight business days later, the tables are delivered. Sally is upset as the tables arrived 2 weeks late and have a dull, non-gloss finish. She later discovers that the tables were not made of genuine oak wood, but rather maple wood. Maple wood furniture is of a similar quality to oak wood furniture, but can only be manufactured with a non-gloss finish.

Advise Sally as to whether John has broken any promises towards her and whether she has any course of action against John under Contract Law.
