John owned a fee simple in a property known as Windy Pines, which contained a campground. Although John had no children of his own, he had a younger brother James and a younger sister Eve. John wanted to ensure that they enjoyed the benefit of Windy Pines. Upon John's death, James and Eve inherited a fee simple in Windy Pines as joint tenants, and for years, they ran the business together. While there was no conflict between the siblings in the operation of the campground, trouble arose after James suffered a tragic camping accident. Eve learned that James was planning to pass his interest in Windy Pines by his will to his son Emile. Emile, who had no interest in running a campground, was threatening to sell his interest and get out of the business. Eve sued the estate of James.
