Jomas was very excited to occupy his newly-built mansion facing the sea. He wanted his new mansion to be lavishly furnished and decorated, and equipped with state-of-the- art facilities and appliances. Money is not an issue to Jomas who is one of richest eligible bachelor in Malaysia. Jomas had always wanted to install a personal home elevator in his mansion to ease the movement of his wheelchair bound mother, Madame Priya. Jomas also wanted to purchase the most expensive refrigerator in the world. Daniel Boaventura recommended the Meneghini La Cambusa refrigerator which costs USD40,000 to Jomas. On 23 June 2021, Jomas had entered two contracts with Luxlive Sdn. Bhd. as follows:

(i)A contract for the installation of a personal home elevator; and (ii)A contract for the purchase of the Meneghini La Cambusa refrigerator.

As a result of poor installation of the home elevator, serious damage was caused to the flooring and walls surrounding the elevator. To add salt to the injury, the Meneghini La Cambusa refrigerator is defective after six months and could not be used at all. Jonas wished to claim against Luxlive Sdn. Bhd. in respect of both these matters, under the Sale of Goods Act 1957.
