Jordan was driving to a police auction to buy a diamond ring that was seized by the police from a drug dealer. Jordan intended to purchase the ring at the auction for up to $25,000 and then flip/sell the ring to a buyer, Mr. Rahman. Mr. Rahman had already committed to buy the ring from Jordan for $45,000 based on the specifications and picture of the ring Jordan had sent him. The auction was starting at 3:30 p.m. Jordan's office was 30 minutes' drive from the auction house. Jordan left his office at 2:00 p.m. He had plenty of time to get to the auction house. While driving, his car was hit from behind by Dinesh's car. Dinesh was on his cell phone with his girlfriend, Simran, who was breaking up with him and Dinesh was trying to convince her not to. Dinesh was not paying attention and hit Jordan's car. Jordan suffered a whiplash type injury but the injury only lasted about 1 month and he did not have to take any time off from work. However, he missed the auction because by the time the police came and finished taking an accident report allowing him to continue on his way, it was 5:15 p.m. and the auction had ended. At the auction, no one was really interested in bidding for the ring but Earnest who was there to look at buying other things, saw that no one was bidding for the ring and thought he would try his luck and picked up the ring for his girlfriend Mabel, for only $5,000 which was the price the auctioneer started at. Had Jordan been able to make the auction he would have for sure been able to buy the ring given his budget for $25,000. He would have likely picked it up for $5,000 because Earnest only raised his hand to buy it because no one went for the ring after the auctioneer repeatedly called for attendees at the lecture to bid for it. Jordan would likely have made a profit of $40,000 on the ring and, even if he had been able to purchase the ring at the top of his budgeted price, he would have made at least $20,000 in profit. You are a lawyer. If Jordan wants to sue Dinesh in civil court and comes to you for advice. Explain what advice you would give him in terms of damages he can sue Dinesh for? Explain your answer in full detail.
