. Julia Johnson was employed by a housekeeping agency. For up to l hours a day, 5 days a week, Julia went to client homes to clean and perform other housekeeping chores. This involved a lot of walking, bending, squatting, cleaning showers, and pulling bed sheets. Aer a few years in this job, Julia noted increasing pain in her elbows and knees. It got to the point where she had difculty at worlc lulials doctor told her she had muscle strain injuries in her elbows and knees and attributed the problem to Julia's job duties. Julia led a claim with the Workers\" Compensation Board. The case manager who handled Julia's claim determined that her injuries did not arise out of or occur in the course of her employment, so denied the claim. Julia requested a review of the decision, and a resolution specialist upheld the case manager's decision. Julia appealed the decision to the Appeals Commission. Policy {3201 of the WCB establishes the criteria for acceptance of a worker's claim for injury. The policy states that, for an injury to be considered compensahle, an accident must meet two conditions. It must arise out of and occur in the course of employment. An accident arises out of employment when it is caused by some employment hazard, which is defined as an employment circumstance that presents a risk of injury- An accident occurs in the course of employment when it happens at a time and place consistent with the obligations and expectations of employment. The Appeals Commission denied Julia's appeal. It concluded that her injury did not arise out of and occur in the course of her employment.
