Gonzalex v. Raich was a political case that essentially gave Congress power to assert itself into intrastate commerce of which should be decided by the states. The totality of the effects of previous cases that were used by the Supreme Court to decide this particular case solidified the federal governments power to inject itself in the government of individual states. In and of itself both the marijuana produced by the plaintiffs was insignificant as the same was true for wheat in Wickard v. Filburn. The same assumption was made in this case in 2005 as it was in 1942 in that the court viewed the significance of the marijuana as insubstantial, but when considered as a whole and its possible effect on intrastate commerce if all the home cultivated medicinal marijuana were considered it would be significant. It is this significance and the regulation of both the legal and illicit drug markets would have a tangible effect on interstate commerce and void the CSA statute. The battle at the Supreme Court may have been lost, but the war is far from over. States agree that there is no difference in the state and federal laws concerning drugs with one consideration. California declared in 2007 that they will not let sick patients suffer and since 2006 California and other states have drawn the battle line (Lucido, 2008). According to Beerel (2007) the states would have to protect their citizens and wait for the federal government to catch up. In 2014 the Rohrabacher-Farr amendment was signed into law, which prohibits the federal government from interfering with state cannabis laws. In a 2017 Gallup poll more than 66% of America supports the legalization of cannabis, and in 2018 the farm bill legalized and de-scheduled low-THC cannabis products from the CSA. As of 2021 more than 34 states have de-criminalized cannabis use for either medicinal or recreational use. 8 GONZALES V. RAICH Regardless, of the opinion and the outcome in Gonzales v. Raich this shows the solidarity of the American people in a representative government. When the majority of the people vote for their needs and want that call is answered by the people that are elected; in this case the legalization and de-criminalization of marijuana.
