Justin and Michael are residents of Bellevue, Washington, and want everything to be perfect for their upcoming wedding. They have rented a large ballroom in the Westin Bellevue, selected peonies, gardenias, and hydrangeas to be displayed on every table, and hired a band that plays outstanding salsa music. In fact, Justin and Michael traveled all around the Pacific Northwest listening to different bands and selected the local rock group Hot Spice for their reception. Justin and Michael signed a contract for $4,500 with Hot Spice two months before the big day. On the day of the wedding, a band called Hot Spice II arrived at the Westin Bellevue. Justin was in tears. This was not the band they hired. Hot Spice II were going to ruin his perfect day. When confronted about why Hot Spice was not there, the Hot Spice II lead singer, Geraldo Diaz, responded that they worked with Hot Spice. Mr. Diaz asked Justin whether he had read the contract carefully. One of the provisions in the written agreement stated that "either Hot Spice or Hot Spice II would perform at the wedding reception." The contract clause continued that "both bands play primarily salsa and Latin music and also are available to play other standard wedding music." Justin was furious and could not believe it. Michael consoled Justin, telling him not to worry and that he was sure the band would be just fine. Anyway, they needed music! Although Hot Spice II was a hit with the attendees, and "rocked" the reception, Justin felt like he had been lied to and would like to sue Hot Spice for breach of contract. He also does not think they should have to pay Hot Spice II the $4,500. Do Justin and Michael have a strong breach of contract case? What are each parties' legal options? Explain your answer and discuss all issues as they relate to your notes on performance.
