In the state of Nextlandia, a claim is submitted for the cost of the drug to Nextlandia's Medicaid. The claim is paid according to a percentage of the drug's mean wholesale price (WP). Like other drug makers, Kaalev published its products' price. But for more than a dozen years, Kaalev set each amount to meet the requirements to obtain a generic designation for the drug, without regard to the actual price. When Nextlandia Medicaid learned that the actual prices were much lower than the published WP, the state filed a lawsuit in a Nextlandia state court against Kaalev, alleging fraud.
