Kadir, in Kuala Lumpur, wrote to Ibrahim in Johor Bahru, a manufacturer of aerated orange drink, to inquire if he would be able to supply 2000 boxes of that drink to be packed in 10 boxes per pack and if so, at what price. Ibrahim, when he received Kadir's letter, replied that he would be able to do for a price of RM10 for each pack of 10 boxes. Kadir, when he received Ibrahim's letter, replied confirming an order of 2000 boxes to be packed in 10 boxes per pack. Ibrahim replied confirming Kadir's order. Later Kadir received the consignment from Ibrahim. He discovered that Ibrahim has sent 2000 boxes packed in 20 boxes per pack. Kadir refused to accept the consignment. Ibrahim now wishes to seek court action against Kadir for refusing to accept the consignment. Advise Kadir whether he would be liable if Ibrahim takes court action against him.
