Kari Q'Anon has been watching a lot of cable news, and she is gearing up for a ght. She's angry that President Biden won the 2020 election, and she thinks it was stolen. So Kari gathers some of her friends from a local militia, called the Oath Creepers. They're known to get violent during protests. Kari and the Oath Creepers head to downtown Phoenix and start protesting in the city park across the street from the Federal Courthouse. They're loud and offensive, but otherwise peaceful. But at 9pm, Phoenix Police arrive and threaten to arrest the protesters for violating the city noise ordinance, which calls for "quiet hours\" in city parks between 8:30pm and 6:30am, Sunday through Thursday. When she sees police arriving, Kari yells, \"They're coming to get us! Attackll Attack now!!" None of the Oath Creepers actually attack the police. Theyjust disperse and go home. But police arrest Kari on charges that stem from what she commanded the Oath Creepers to do. The Johnson family is nishing up their cookout at the park at around this time. They're walking to their car and pass Kari in handcuffs. She looks at little Sally Johnson, who is eight years old, and yells, \"Little girl! If you don't do what Q tells you, you'll end up in jail just like me!" Little Sally starts crying, becomes obsessed with what 0 might tell her, begins wetting the bed and starts seeing a child psychologist. A week later, Robbie Reporter is sitting in the KNEWS newsroom when he gets a call from one of his police sources. The source tells him the FBI is going raid Kari Q'Anon's home because they believe she's been conspiring with the Oath Creepers to commit violence against the government. Robbie heads over to Kari's home, which is surrounded by a 10 foot high brick wall. He sees a tree in the neighbor's yard, and decides to ask the neighbor if he can climb the tree to video-tape Kari's back yard. The neighbor, who doesn't like Kari or Q'Anon, gives Robbie permission. So he climbs the tree, looks over the wall and sees Kari in her back yard, talking to some Oath Creepers. None of them has clothes on. They're all stark naked. Robbie video-tapes them from high in the tree, and captures the commotion when the FBI agents show up to raid the home. In his exclusive story, Robbie states that he was tipped off to the raid by a source. On TV, the naked bodies are blurred so as not to show any nudity, but Robbie publishes the raw video on the internet, showing lots of nudity. Two days later, FBI agents show up at the KNEWS newsroom and demand to know the identity of Robbie's source. They are investigating the leak, which violated federal law. 1. Is the city noise ordinance constitutional? Why or why not? (Use IRAC) 2. What charge will Kari face for her command to the Oath Creepers? And will the prosecution succeed? (Use IRAC) 3. What lawsuit could little Sally Johnson file against Kari? And would it succeed? (Use IRAC) 4. If Kari sues Robbie, what lawsuit would she file and would it be successful? (use IRAC) 5. Would the FBI agents, or federal prosecutors be successful in demanding to learn the identity of Robbie's source? (Use IRAC) 6. If prosecutors file obscenity charges against Robbie, will the prosecution succeed? (Use IRAC) 7. Let's say Kari's defense attorney wants to close the courtroom to the public in her trial. Describe the process that would take place. (Do not use IRAC here. Just describe the steps)
