Katy, an experienced 50-year-old businesswoman, owns and runs a successful fashion store called "KATY'S" in Melbourne City. Katy's store specializes in premium quality linen clothing. Jamey, a regular customer of KATY'S, purchases clothing items in bulk from KATY'S to sell online. Katy generally provides a two-week credit period for Jamey to complete his payments. After processing an order placed by Jamey, Katy sends an invoice for $5000 to Jamey. Due to the pandemic, Jamey's business was not doing well. Four weeks after sending the invoice, and despite sending two reminders, Jamey failed to 2 settle the invoice. Katy calls Jamey to follow up on the invoice. Jamey promises to pay the invoice in one week. Another two weeks go by without receiving any payment from Jamey. Katy calls James again to check on the payment and Jamey responds, 'I am really having a hard time these days and the truth is that I do not have money to pay that invoice.' Katy, realizing that she may lose all the money owed by Jamey, asks, 'Why don't you pay me $3000 and give me a reference to your uncle Dave who works for the Fashion Magazine?' Katy knew that Jamey's uncle works closely with young celebrities. Jamey replies, 'That sounds perfect. I will give a glowing recommendation to Uncle Dave. He has lots of connections with celebrities. He will make sure to get you some big contracts.' Katy agrees to the deal. Is the new agreement between Katy and Jamey to accept $3000 of the invoice amount legally binding?
