Question 1 May Lin has been offered employment as an Accounts Clerk in Nadi Bayu Son Bhd with basic salary of RM 1680. She came to see you, her cousin who is also an HR consultant to seek your advice regarding the contract of employment that she receives from the company. 15 September 2022 Dear Ms. Chen May Lin Nadi Bayu Son Bhd is pleased to offer you a position in our expanding company. We are appointing you as an Accounts Clerk attached to the Department of Accounting and Finance in Nadi Bayu Son Bhd. You will be reporting directly to Mr. Joseph Low, the Manager. Your employment shall commence on 1 October 2022. The terms and conditions of your employment are as follows: Position Accounts Clerk, Accounting and Finance Department Salary Ringgit Malaysia 1680.00 only The company reserves the right to deduct or withhold salary payment should you breach any of the terms and conditions of your employment. Your salary will be subjected to all necessary deductions as required by the law at the prescribed rate. Hours of Monday to Saturday 8.30 am to 5.30 pm. Lunch Break is 1.30 to 2.15 Work pm In the event you are required to work overtime, you will be paid RM7.50 per hour for any extra hours that you do, subject to confirmation from your supervisor. Probation You will be put under a probation period of THREE (3) months starting Period from the date of commencement of work. The management reserves the right to extend your probation period or to terminate your service at any time during the probation period without needing to give notice. Public You will be entitled to enjoy ELEVEN (11) paid public holidays per Holiday year. (Please refer to the Employee's Handbook for the public holidays observed by this company. However, the company may refuse to observe unplanned public holiday declared by the authority and substitute such holiday any way it deems fit.) Annual After 12 months of service, you will be entitled to EIGHT (8) days leave annual leaves. Take note that approval of application of annual leave is solely at the discretion of the company's management. Application for leave must be submitted FIVE (5) days prior to taking any leave, failing which the application will not be entertained.Sick After 12 months of service, you wil be entitled to TWELVE (12) days Leave paid sick leaves. Take note that approval of sick leave is solely at the discretion of the company's management. The company will only accept medical certificate issued by approved panel clinics or government hospital. Entitlement for subsequent years of service is as stated in the Employee's Handbook Maternity Only confirmed female employees are entitled to apply for paid Leave maternity leave in the company. 60 days paid maternity leaves in total will be given to all female employees who give birth up to a maximum of THREE (3) children. Any birth after the third child will only entitle the employee to 40 days paid maternity leave. Notice Both parties in this contract are entitled to serve a FOURTEEN (14) days termination notice to the other party without the need to provide any reason for such termination. Other All other terms and conditions of service are as stated in the terms and Employee's Handbook available on the company website. The condition company reserves the right to amend, delete or alter any of the terms of employment stated above as deemed necessary without prior consultation with the employees. All amendments made, as and when necessary, will be circulated via the employee's portal.
