Kloud 9 Kitchen (K9K) is a restaurant located in Melbournes CBD which caters to the corporate lunch trade during the working week. K9K opened in November 2017. In November 2021, the restaurant started trading again following the easing of restrictions in Melbourne due to the COVID-19 pandemic. Jonah, the owner, was delighted about this and spent $6,000 advertising the restaurant in The Age and on local radio. Unfortunately for Jonah, workers didnt return to the city in the numbers hed expected and even with only minimal chef and waiting staff working each day, K9K is running at a loss each week. Jonah is determined to trade until 24 December 2021 but he needs to find ways to save money.
On 24 November 2021, he comes up with the following five options:
To tell the casual waiting staff that tomorrow will be their last shift at K9K; To not pay superannuation for the next month; To reduce the restaurants trading hours from 10:00-4:00pm to 11:00am-3:00pm; To tell Dina and Glenn, two of the chefs who have worked for K9K since it opened, that they are being made redundant on 24 December 2021 and give them 4 weeks pay; To pay all of the waiting and kitchen staff $21.38 per hour.
Advise Jonah whether he can pursue any of those options without breaching his legal obligations. In your answer you are not required to consider any of the facts revealed in Question 4 and Question 5 or the Restaurant Industry Award 2020.
