Kurt has decided to sell his Apple laptop and upgrade to the latest model. On July 3, Kurt posts a letter to Blake informing him that he is selling the laptop for $150,000.00 and he is to let him know by notice in writing, by July 9, if he is interested in purchasing same. Also on July 4, Kurt called Ken indicating to him that he is in the process of changing his gaming machine and if Ken is interested in purchasing same for $100,000, he is to telephone him by 5pm on July 10. Blake received the letter on July 5 and upon reading same immediately responds by sending Kurt a lette with the cheque for $150,000.00 which he takes to the post office himself. Not hearing from Blake, Kurt sold the laptop to Jada on July 10. Blake's letter got lost in the post and Kurt did not receive it until July 11. After Ken received the call from Kurt, he called Kurt the following day, having contemplated the price and told Kurt that the price was too high. He would be willing to pay $70,000.00 for the gaming machine. Kurt told him no. Early the following morning, Ken called back Kurt and informed him that he would come the next day with the $75,000.00 in cash and $25,000 worth of cocaine for a total of $100,000 that he wanted for the machine.
