l '|'|'|'|@| Georgina wanted to buy some window shades for her new house in preparation for the hot Australian summer. She wanted the window shades to keep the direct sun out and to keep her house cool. Georgina went to 3833 Pty Ltd to have a look at their blinds and shades and was greeted by Mark, an experienced salesperson. Georgina explained that she wanted some window shades that would keep out most of the heat of the sun on very hot days. Mark then said, " well then you can't beat the AMF window shades, they are the best on the market and they are guaranteed to keep out 80% of the sun's heat!' Georgina, replied, " are you sure, they look a little thin, will they really be able to keep out 80% of the heat?' Mark, replied, "deniter I wouldn't tell you if it were not true." Georgina then showed a blurry picture of the interior walls of her house and asked if the shades will match the dcor of her house to which Mark said, "that's really a personal taste and I 'm not a designer but it should look a Georgina then agreed to sign the written contract. There was a large sign above the counter where Georgina was signing the contract which contained the following exemption clause: The Australian consumer law does not apply to any product sold in this store. Only the manufacturer's warranty is valid. Georgina looked at this sign as she was purchasing the product, but did not bother to ask Mark what it meant. Georgina went home and a few days later the window shades were installed. 0n the first hot day her house became unbearably hot even though she had the shades down and the air condition turned on! She has since learned that customer reviews of this product have been terrible with people complaining that the shades do not lter more than 10% of the sun's heat. Further, she has read that an independent review found that the shades only filter 7% of the sun's heat and are thus completely unsuitable. Lastly, she was unhappy with the shades appearance, claiming it does not match the dcor of the house! Required: Advise Georgina if the SSBB's conduct can be found to be misleading under s 18 of the ACL. (10 marks)
