Lana owns a hair salon. Taylor is one of the hair stylists. In general, Taylor is competent at cutting and styling hair, however she has recently had some legal problems. She had a fight with a flatmate which ended with her breaking the windscreen of his car. Taylor pleaded guilty to damage to property, and was discharged without conviction.

One day Lana notices a thousand dollars is missing from the cash register. She suspects Taylor who stole the money because she was alone in the salon during lunch time. Lana asks Taylor to meet in the staff area at the back of the salon and asks her whether she knows anything about the missing money. Taylor says that she does not and points out that other staff members were also alone in the salon at various times during the day. Lana responds, "but none of the others have your history of being in trouble with the law." Lana goes on to say "I haven't felt comfortable having you here since your fight with your flatmate. Your actions don't reflect well on the salon."

Lana asks Taylor to go home for the day because she wants time to consider what to do. As Taylor leaves the salon, she notices the customers and other stylists staring at her, and realises Lana was speaking so loudly they must have heard the discussion. The next day Lana sends Taylor this text message "don't come back. It's not working out."

Six weeks later Taylor has not been able to find another job. She is upset and humiliated at how she was treated. She asks your advice whether she should bring a personal grievance for unjustified dismissal.

Required:

Apply the law to the facts and discuss whether Taylor is likely to succeed in a personal grievance for unjustified dismissal. Also, explain the remedies that might be available to her should she succeed.
