Elaine used the barbeque cooker first time for a party, it failed to produce sufficient heat to thoroughly cook the seafood she was preparing for her two friends. As a result of this, Elaine and her two friends who ate the seafood sustained food poisoning as the parasites inside the seafood had not been destroyed during the cooking process. Elaine herself incurred medical expenses $3,000.Five days later, Elaine used the barbeque cooker again and the cooker exploded and damaged Elaine's house properties (HK$7,000).Yesterday, Elaine went to the shop to demand for refunding the purchase price or seek a replacement cooker but the shop refused all of Elaine's requests. Elaine wants to sue the seller to claim back her medical expenses and property losses.
