In May 2014, Malaysian Communication and Multimedia Commission (MCMC) appointed a company known as Memara Sdn Bhd to provide Public Cellular Blocking Service (PCBS) that enables the process of blocking and unblocking of reported lost or stolen cellular mobile. The system allowed stolen mobile phones to be blocked from making calls, texting, or assessing the internet, even if the sim card is changed as a mechanism of protection to all mobile phone users. The Malaysian Central Equipment Identity Register {MCE|R) which was a database of International Mobile Equipment Identity {IMEI) number was created to provide a unique serial that can identify each mobile phone registered in Malaysia. In 2014, all telecommunication companies sent notices to their customers that their personal data will be released to the MCEIR, purportedly under the direct supervision of MCMC. All customers will be charge RM2.00 per month for this service. News of possible stolen data from MCEIR was rst highlighted by a website Com.Right in 2015 after an attempt by an unknown user to sell the data on the Com.Right forum. Following this, MCMC has requested that the news of stolen data to be taken down from the web. The investigation carried out by the police found that the personal data stolen from telecommunication companies is directly linked to MCEIR. The data that have been sold includes information such as customer names, billing address and MyKad numbers. The company registration search with the Companies Commission of Malaysia shows that Memara Sdn Bhd is active though, initial report by Com.Right indicated it to be a dormant company. Consider the following and advise accordingly: a. Analyse the rights of an individual relating to data protection in Malaysia. (10 marks) b. Analyse the role of MCMC with regards to data protection in the above facts and identify whether there exists any possibility of abuse. (10 marks) 0.
