(i)Ram's car breaks down ona busy street. Ram asks Sumit, a passing motorist to tow the car to the nearest garage. Sumit tows the car and in return Ram promises to pay Sumit at the garage Rs 1000 as paymentfor the help that he rendered. Is Ram bound by the promise? If yes, on what basis of the Indian Contract Act is he liable to pay? If no, state the reasons for the same.

(ii)Minu has a running account with Upender, having borrowed from Upender different amounts from time to time over a period of years. Among several debts, Minu owes Rs. 567 which falls due on 1 September 2020. She sent a cheque of Rs. 600 on 29^thAugust 2020 without any indication of appropriation of payment. Briefly explain the appropriation of Rs. 600 received by Upender

(iii)Priya guarantees payment to Rita for playing guitar for selected 5 days of a month

(from Monday to Friday) at a music show organized by Anagha. Rita performs from

Monday to Friday. Later, Anagha requests Rita to perform on Saturday as well but

Anagha does not pay Rita for the Saturday performance. Considering Priya is the

guarantor, is she liable to pay Rita for the Saturday performance? Justify your answer

(iv)A real estate agent is selling a property to 'A' that has a major defect but the agent is

unaware of the defect because the owner 'B' of the property told the agent that there is

nothing wrong with the house. Hence, A and B get into a contract. Later, A comes to

know from other sources about the defect. Can A claim for breach of contract? Justify your answer (
