The first of these categories refers to "colonized territories, which persist following the withdrawal of western authority." Patrick H. Glenn, Legal Traditions of the World 85 (5th ed. 2014) Comprised mostly of "African and Asia" id., here chthonic law tends to survive in conjunction with or even at the expense of existing states laws. The second form of chthonic law is comprised of states "constructed by western powers in the process of permanent settlement in colonized territories, which persists as an ongoing instrument of western authority." id. In these states, mostly in the "Americas and Australasia" id., chthonic law has greatly diminished due use of concepts like reservations. In these states chthonic law has been reduced to a general recognition by states as a form of tradition. In both cases chthonic law has ultimately been replaced by more codified legal systems.

While, chthonic law has become more obscure, its concepts regarding humanity's relationship to the land/environment continue to influence modern law. "[C]hthonic thought on environmental attitudes in the west has been significant." id. at 89. This concept that we are connected to the environment and thus responsible for its care is present in most state's codified laws. Laws regarding Public land usage have also been greatly influenced by chthonic concepts. "The use of western courts to affirm and protect chthonic use of the land has already been noted." Id. at 90. While chthonic law is no longer in exclusive use, it has remained relevant in modern cultures.

Parallels can even be drawn between chthonic tradition and Christian oral tradition. Chthonic law existed primarily in its people. As Glenn states: "[I]mportant information is learned by all, with the help of many, and all become able to assist in the ongoing process." id. at 65. This understanding that the law was held in the hearts of the people, and thus deeply personal and yet communal. All became practitioners and guardians of the law. In a similar fashion the apostle Peter states, "[F]or you are a chosen people. You are a royal priesthood, a holy nation, God's very own possession. As a result, you can show others the goodness of God, for he called you out of the darkness into His wonderful light." 1 Peter 2:9 (NLT) As Elwell states, "There remains, however, a priesthood which belongs to those who through faith have been united to Christ."
