Jones filed a lawsuit against the Uber Technologies Corporation, for, among other things, battery; assault; false imprisonment; and intentional infliction of emotional distress. On a page of its rider sign up process, Uber displays a statement that says, "By clicking 'Sign Up, you agree to Uber's Terms of Use." The hot linked Terms of Use, to which Jones had implicitly agreed, include several legal disclaimers (written in all capital letters), including the following: UBER DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY OR ABILITY OF THIRD PARTY PROVIDERS. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICES... REMAINS SOLELY WITH YOU... UBER DOES NOT CONTROL, MANAGE OR DIRECT ANY THIRD PARTY PROVIDERS INCLUDING DRIVERS.
