Linda owns and operates a transport business, Linda Translines. She has been engaged Judith to deliver flowers from Judith's farm in Naivasha to Nairobi Airport. Linda's driver, Thomas, is expressly barred the conditions of his employment from carrying anything or anyone without the authorization from the company's transport manager. Thomas, after picking the flowers, decided to drive on to Nakuru to drop his brother in law, before turning back and making for Nairobi. Unfortunately, as he was speeding towards Nakuru, in the opposite direction, he did not see a car approaching from a junction, and rammed into it, badly injuring the car's driver, Louis. Louis is threatening to sue Linda. Advice Linda as to her liability, if at all.
