Liz Gwynne, engages a singer, Archie Poach, for a series of five concerts in 2022. These concerts are planned to be held at the Melbourne Convention Centre which charges $10,000 hiring fee for the auditorium per event. Two days before the first concert, Archie tells Liz that he is taking a career break and he will be unavailable for all of the five concerts. All five concerts will have to be cancelled. Liz has already sold 500 tickets for the first event, to the public.

You are Liz Gwynne's lawyer.  Liz wants to sue Archie for:
(a) Loss of profits arising from the tickets that had already been sold. Now Liz must give refunds to the purchasers of the tickets, totalling $50,000.
(b) The hiring fee of $10,000 which Melissa has already paid to the Melbourne Convention Centre to hire the venue for the five concerts.
(c) Expense for the event merchandise (Archie Poach T-shirts, hats and scarves). Liz has never discussed selling event merchandise with Archie, but she has already paid $10,000 to manufacture the T-shirts, hats and scarves, which she planned to sell at the events.   Liz did not think Archie would object to selling the merchandise and she was going to mention it to Archie on the day of the first concert.

  1. What adviseshould be given to  Liz about the likelihood of success of recovering the above expenses in a legal action. Refer to relevant cases and/or statutory law
