Look up the Labour Relations Code, RSA 2000, c L-1. Does this statute create any institutional bias in the Labour Relations Board? Explain. Ensure you refer to the relevant sections. (5 marks) You have applied for a daycare license. You have secured a location in a busy strip mall, in a new and thriving neighbourhood of the City. The LRT expansion will be running right outside the door within a few years, and this will be great for business. You don't have experience running a daycare facility as such, but you have plenty of experience teaching children in a pre-school setting. You have also taught English as a second language in several foreign countries. There is legislation that governs the daycare industry in Alberta - the Daycare Licensing Act (this is fictional). It was enacted after an outcry concerning unregulated daycare facilities. Several children had wandered away from their care facilities, and some facilities had violent offenders working as care givers. Part of the Daycare Licensing Act reads as follows: 17. A daycare license must be denied if: (a) there is any unpardoned criminal conviction of the applicant, or (b) there is no satisfactory proof of adequate liability insurance coverage for the proposed daycare facility. 18. A daycare license may be denied for any reason that the licensing officer considers might endanger safety of the children attending the facility. Discuss whether you think any principles of administrative law are violated in the following circumstances. Make sure to adequately justify your answer based on all applicable administrative law principles covered in class and the textbook. a. You were denied a license because the officer thought that your new daycare would bring no real benefit to the neighbourhood. (4 marks) b. You received a letter denying your license. When you called to ask why the license was denied and how you can appeal your decision, you were told the hearing will be tomorrow at 8am and you can ask any questions then. (4 marks) c. You were denied a license because, while teaching English in southeast Asia, you were convicted of spitting on the sidewalk - a crime in that country. (4 marks) 3. List three sources where specific rules for procedural fairness can found. (3 marks) 4. Name and briefly describe three components of the right to be heard. (6 marks) 5. You are representing your client, Peter, at his disciplinary hearing. One of the panel members worked with Peter at a previous place of employment. In terms of timing, why is it necessary to raise the question of whether there is an appearance of bias as early as possible? (4 marks)
