Lord Melbury decided to open his stately home, Nottingly Hall, to the public for a day to raise money for charity. He hired a bouncy castle for the event from Phoenix Ltd. Barry and his five year old daughter, Claire, were among the visitors. While Barry was buying a cup of tea, Claire spotted a swing hanging from a branch of a tree in the gardens and ran over to go on it. On the tree trunk by the swing was a large sign which said "SWING UNSAFE. DO NOT USE." As she started to swing, the rope, which was badly frayed, it broke, and Claire fell to the ground. Her arm was broken and her glasses were smashed. Neeta, aged thirteen, paid to go on the bouncy castle. Unfortunately, while she was on the bouncy castle it exploded, badly injuring her. It later transpired that Phoenix Ltd's public liability insurance had expired the week before the accident. It was a very hot day and Sam, a student 21 years old , decided to go for a swim in the lake, despite clear notices all round the lake saying "No Swimming". He dived in at a point where the water was very shallow. His head hit the bottom of the lake, and he was left paralysed as a result of the accident. Advise Lord Melbury as to his possible liability in tor towards Claire, Neeta and Sam.. This case is happen in Canada
