Lorraine, your neighbour, comes to you for advice. Lorraine tells you that one day she was walking up a luxurious street in Toronto when she passed by a couple photographers taking pictures of the city-scape for a newspaper article. From what she recalls, the photographers and their crew were running a story about affordable housing. Lorraine is very passionate about having affordable housing in the city and took this opportunity to make her views known. In protest, she raised both of her middle fingers in the background as she passes by.

A week later, the story is published in the Toronto Star, and Lorraine is seen in the background of some of the pictures with both her middle fingers up, considered by many to be offensive. Lorraine is employed at a restaurant owned by Enrique. The next day, Enrique calls her into her office and tells her he was very disappointed in her and may fire her because of all the complaints.

Lorraine believes that it was her right to express how she felt and it had nothing to do with her employment. She believes that if her employer fires her, it would be violating Lorraine's right to freedom of expression under section 2(b) of the Canadian Charter of Rights and Freedoms. Section 2 of the Charter reads:
